1. Who we are

Pokiq is a poker training platform, reachable through this site and the accompanying web application. Questions about these terms can be sent to the contact address on the about page.

2. What you get from Pokiq

Pokiq analyses your poker play and gives you insight into it: a Poker IQ score, detection of recurring patterns in your game, practice material, an AI coach and tracking of your results. Which parts you get depends on your subscription.

Pokiq is an analysis and learning tool, not a guarantee of profit. Poker has variance and you can lose money. The insights are statistical in nature and not a certainty. Pokiq does not give financial advice and is not liable for your results at the table.

3. Your account

The following applies when you use Pokiq.

• You are at least 18 years old, or older where the law in your country requires it.
• You do not share your login details with anyone.
• You only upload hand histories from accounts that are your own.
• You do not create multiple accounts to get around the limits of the free plan.

What is not allowed:

• Using Pokiq for advice during a hand you are playing. That is called real time assistance and it is banned on virtually every poker site. Pokiq is meant for study between sessions.
• Uploading hand histories of other players without their permission.
• Reverse engineering, scraping or placing an automated load on the service.
• Posting content that is unlawful or that infringes someone else's rights.

If you break these rules we can restrict or end your access. In the case of a serious breach that can happen immediately and without a refund of the current period.

4. Subscriptions and payment

Pokiq has three plans: Free, Pro and Elite. Free is free and stays free. Pro and Elite are paid subscriptions.

The current prices and the exact contents of each plan are on the pricing page. That page governs. These terms contain no amounts, so that a price change can never leave two documents contradicting each other.

Payments run through an external payment service provider. Your full payment details do not reach Pokiq. A paid subscription continues until you cancel it.

Price changes. If the price of your running subscription changes, we tell you at least 30 days in advance. If you do not agree, you can cancel before the change takes effect at no extra cost.

5. Cancellation and withdrawal

You can cancel at any time in your account settings. You keep access until the end of the paid period, after which your account falls back to Free. There is no notice period and no penalty.

Right of withdrawal. As a consumer you have 14 days to withdraw after taking out a paid subscription. Because Pokiq gives access to digital content immediately after purchase, at checkout we ask for your express consent to begin straight away and your acknowledgement that you thereby lose your right of withdrawal. If you do not give that consent, your access starts after the withdrawal period.

You can delete your account entirely yourself, in your settings. What happens to your data then is described in the privacy statement.

6. Your data and your content

Your hand histories and the analyses of them remain yours. Pokiq uses them to deliver the service to you and to improve the service, as described in the privacy statement. Pokiq does not sell your data.

The software, texts, practice material and the Pokiq brand remain the property of Pokiq. You get a personal, non transferable right of use for as long as your subscription runs.

7. Availability

Pokiq aims for a service that works well, without a guarantee of uninterrupted availability. Maintenance, failures at suppliers or changes to features can lead to temporary interruptions. In the event of a long interruption for which Pokiq is responsible, you can ask for a proportionate refund over the paid period.

8. Liability

Pokiq is not liable for losses at the poker table, for decisions you take on the basis of the insights, or for consequential damage. Pokiq's liability is limited to the amount you paid in the twelve months preceding the event. This limitation does not apply in the case of intent or deliberate recklessness, and not where the law prohibits a limitation.

9. Changes

Pokiq can amend these terms. In the case of substantive changes that affect you, we tell you at least 30 days in advance. If you keep using the service after that, the new version applies. If you do not agree, you can cancel.

10. Governing law

Dutch law applies to these terms. Disputes are put before the competent Dutch court. As a consumer you keep the right to go to the court of your place of residence where the law provides for that.
